Errors & Omissions Coverage Descriptions

The following descriptions provide a basic explanation of coverage included in Target‘s A & E policy. Wherever these explanations may differ from actual policy language, the policy language prevails.

Contractors Pollution Liability

Covers damages and claims expenses incurred as a result of pollution at a contract site arising out of the performance of contracting services performed by the insured, or any entity from whom the insured is legally liable – provided the services were performed on or after the policy effective date (or retroactive date) and before the end of the policy period.

Computer Network Security

Covers damages and claims expenses incurred as a result of providing or managing computer systems security by the insured or any person or entity for whom the insured is legally liable – provided the negligent act, error or omission was committed or alleged to have been committed on or after the policy effective date (or retroactive date) and before the end of the policy period.

Environmental Legal Liability

Covers damages and claims expenses incurred as a result of pollution arising from professional services performed by the insured, or any entity for whom the insured is legally liable – provided the services were performed on or after the policy effective date (or Retroactive Date) and before the end of the policy period.

Multimedia and Advertising

Covers damages and claims expenses imposed by law resulting from a claim made against the insured as a result of negligence by the insured or any person for whom the insured is legally liable for providing Professional Services, Media Activities or Technology Services. Coverage highlights include:

  • Defamation, libel, slander, product disparagement, trade libel etc.
  • False arrest, detention or imprisonment or malicious prosecution
  • Misappropriation of any name or likeness for commercial advantage
  • Plagiarism, piracy or misappropriation of ideas under implied contract
  • Infringement of trade dress, domain name, title or slogan
  • Infringement of copyright
  • Negligence regarding the content of any media communication

Privacy

Covers damages and claims expenses arising out of any privacy breach, breach of privacy regulations and employee privacy breach by the insured or any person for whom the insured is legally liable up to $200,000, which is part of and not in addition to the overall policy limit of liability.

Rectification Expense

Reimburses the insured for rectification expense up to $250,000 for any reasonable and necessary fees, costs and expenses incurred by the Insured for rectification of a design defect caused by professional services in any part or the construction works or engineering works for and project for which the insured is responsible for both design and construction. The $250,000 limit is part of and not in addition to the policy limit of liability.

Supplemental Payments

Target’s carrier partner automatically includes Supplemental Payments for specific incidents relating to professional liability services rendered during a policy term. There is no additional cost and the policy deductible does not apply. Supplemental payments are designed to cover the following (see policy for more detailed explanations and coverage limits):

  • Pre-claim assistance
  • Defendants Reimbursement
  • Regulatory / Administrative Actions Reimbursement
  • Disciplinary Proceedings Reimbursement

ADDITIONAL SUPPLEMENTAL PAYMENTS

Crisis Event Expenses covers any reasonable fees and expense incurred by the insured for consulting services provided by a public relations firm to the insured in response to a crisis event.

Privacy Breach Response Reimbursement covers any reasonable fees and expense incurred for forensic investigation into the cause and extent of a privacy breach affecting computer systems and unauthorized access to personally identifiable information stored on computer systems.

Technology Coverage

Covers damages and expenses for claims made against the insured during the policy period as a result of any wrongful technology act – provided the wrongful act was committed (or alleged to have been committed) on or after the policy effective date (or Retroactive Date) and before the end of the policy period.
